Trump officials are deliberately replicating the playbook that led to Nuremberg. The documentation exists. International jurisdiction is inevitable.

The documentation is already compiled. ICC jurisdiction exists the moment deportation flights land in member states. Democratic subpoenas can issue January 2027. Foreign prosecutors require no American permission; authorities arrested Chilean dictator Pinochet in London on this precedent. The question becomes not whether Trump officials will face tribunals, but when accountability arrives.

Trump’s June 2025 directive read: “ICE Officers are herewith ordered, by notice of this TRUTH, to do all in their power to achieve the very important goal of delivering the single largest Mass Deportation Program in History.” He named Los Angeles, Chicago, New York. Miller ordered 3,000 arrests daily. Privately, the administration targeted one million deportations in Trump’s first year. DHS posted an image depicting “America after 100 million deportations” as paradise, captioned: “The peace of a nation no longer besieged by the third world.”

On January 15, 2026, ICE agents threw tear gas beneath a family’s car in Minneapolis. Their six-month-old infant required CPR. The family had mounted no attack. Vice President Vance defended ICE tactics eight days later.

At CPAC 2023, Trump declared: “I am your warrior. I am your justice. And for those who have been wronged and betrayed: I am your retribution.” He told Fox News in June 2024: “Revenge does take time, I will say that. And sometimes revenge can be justified.” NPR documented over 100 instances in which he threatened to investigate, prosecute, or imprison opponents.

Asked about Election Day chaos in October 2024, Trump responded: “I think the bigger problem is the enemy from within. We have some very bad people. We have some sick people, radical left lunatics. And I think they’re the big issue, and it should be very easily handled by, if necessary, by National Guard, or if really necessary, by the military.”

In September 2025, speaking to 800 generals and admirals at Quantico, Trump declared: “This is going to be a big thing for the people in this room, because the enemy from within must be handled before it gets out of control.”

Veterans Day 2023 in New Hampshire: “We pledge to you that we will root out the communists, Marxists, fascists and the radical left thugs that live like vermin within the confines of our country that lie and steal and cheat on elections.” Four times in 2023, he declared immigrants are “poisoning the blood of our country.” December rally in Durham, New Hampshire: “They’re coming into our country from Africa, from Asia, all over the world.” Confronted with Hitler parallels, Trump doubled down in Waterloo, Iowa: “I never read ‘Mein Kampf,’” then immediately continued: “[Immigrants] are destroying the blood of our country, they’re destroying the fabric of our country.”

Hitler wrote in Mein Kampf: “All great cultures of the past perished only because the originally creative race died out from blood poisoning.” Trump’s denial followed by repetition reveals deliberate choice. Presidential historian Jon Meacham observed: “To call your opponent vermin, to dehumanize them, allows one to not only open the door, but to walk through the door toward the most ghastly kinds of crimes.”

Congress authorized $45 billion in July 2025 for ICE detention facilities through 2029. Capacity expanded to 135,000 beds, three times larger than when Trump took office and 62 percent larger than the entire federal prison system. Infrastructure includes warehouse facilities, tent camps on bases, reopened prisons. Twenty-three people died in ICE detention in fiscal 2025 versus 24 total in the previous four years. Seventy-five percent of detainees have no criminal conviction. Discretionary releases fell 87 percent.

Courts found ICE conducted stops “based on assumptions about race,” made warrantless arrests, denied lawyers, coerced deportations. ProPublica documented over 170 U.S. citizens detained in 2025. A secret ICE memo authorized warrantless home entries using administrative warrants agents sign themselves. Under Secretary Noem, detention rose 75 percent to 66,000 people.

Chicago Mayor Brandon Johnson called operations “a war on democracy.” Armed agents smashed car windows, yanked people from vehicles, wrestled others to the ground. One ICE agent aimed a pistol at a civilian spectator: “bang bang” and “you’re dead, liberal.” Trump’s directive targeting cities that voted against him transforms enforcement into political punishment.

Killing Survivors in International Waters

On September 2, 2025, U.S. aircraft struck a Caribbean fishing boat and killed nine people instantly. Two survivors clung to the capsized hull, waving, for twenty minutes. Defense Secretary Hegseth authorized the operation. A second strike was ordered. Both men died. The Washington Post reported Hegseth issued a verbal directive to “kill everybody” on the boat. The White House later claimed Admiral Bradley made the decision and “was well within his authority to do so.” Between September and December, 35 strikes killed 115 people, many fishermen. Colombia accused the U.S. of murdering fisherman Alejandro Carranza, who had no drug trafficking ties.

Regime Change Without Congressional Authorization

On January 3, 2026, under Trump’s orders, Delta Force captured Venezuelan President Nicolás Maduro in Operation Absolute Resolve using 150 aircraft. More than 80 people were killed, including 32 Cuban military personnel. Trump announced the U.S. would “run” Venezuela indefinitely while oil companies “fixed” infrastructure for reimbursement from reserves. Congress provided no authorization.

Trump threatened military action against Colombia, Greenland, Canada.

Weaponizing the Justice System

FBI Director Patel promised “no politicization” and “no retributive actions” during confirmation hearings. He has since directed agents to sift through sensitive case files targeting Trump’s perceived enemies. The New York Times reported the FBI hunts negative information about officials who investigated Trump, distributing material to Republican congressional allies or MAGA-friendly media. Patel fired agents involved in Trump investigations, including six connected to Mar-a-Lago and agents who worked on January 6 cases. He fired one agent for refusing to stage a perp walk for former FBI Director Comey, whom Patel had indicted.

Trump systematically concealed elite criminal conduct. In December 2025, DOJ released heavily redacted Epstein files in which 550 pages appeared fully blacked out. One 119-page document labeled “Grand Jury-NY” was completely redacted. DOJ removed files showing Trump with Epstein from its website. Senator Wyden called this “a continuation of this administration’s cover-up on behalf of a bunch of pedophiles and sex traffickers.”

How Nuremberg Happened

After World War II ended in May 1945, the U.S. insisted on trials rather than summary executions. The August 8, 1945 London agreement created the International Military Tribunal. Each Allied nation supplied one judge, one prosecution team. They chose Nuremberg, where Nazi laws had been proclaimed, as the location where Nazi leaders would face judgment.

From November 1945 to October 1946, 22 senior officials stood trial using Nazi documentation: deportation orders, execution logs, concentration camp budgets. Twelve received death sentences.

Nuremberg prosecuted propagandists and defenders of atrocities. Julius Streicher, an antisemitic newspaper editor who never held government office but defended Nazi crimes, was executed. Hans Fritzsche, a radio broadcaster who justified Nazi policies, was acquitted by the IMT but later convicted by German courts.

Nuremberg established that domestic law does not immunize criminal conduct when the state becomes the instrument of harm.

Stephen Miller’s Goebbels Playbook

On September 21, 2025, Stephen Miller stood before nearly 100,000 people at Charlie Kirk’s memorial and delivered what multiple analysts identified as near-plagiarism of Joseph Goebbels’ July 9, 1932 speech “The Storm is Coming,” delivered months before Hitler’s seizure of power.

Miller transformed Kirk’s death into fascist theatre: “The day that Charlie died the angels wept. But those tears had been turned into fire in our hearts. And that fire burns with a righteous fury that our enemies cannot comprehend or understand.” He declared Kirk immortal, exactly as Nazis elevated Horst Wessel into eternal martyr: “You thought you could kill Charlie Kirk. You have made him immortal.”

Then came the dehumanization. Miller stared into cameras: “To our enemies... you are nothing. You are wickedness. You are jealousy. You are envy. You are hatred. You are nothing.”

Compare Goebbels, 1932: “So our dead comrade Horst Wessel wrote, and we are fulfilling his prophesy. The others may lie, slander, and pour their scorn on us; their political days are numbered.” Both speeches invoke the dead to mobilize the living and promise extinction for enemies.

Miller invoked the builder mythology central to Nazi rhetoric: “We are the ones who build. We are the ones who create. We are the ones who lift up humanity.” Goebbels declared: “You, men, women and comrades, are the bearers, witnesses, builders and finishers of this unique people’s uprising.”

His final words were threat: “You cannot defeat us. You cannot stop us. We will finish the job. You have awakened the dragon.” Goebbels stated: “Well, we the people have awakened! We have risen against oppression; 15 million people have joined in an army of revenge.”

Both speeches deploy martyrdom as mobilization, cast opponents as ontological void, frame the movement as eternal builders, treat awakening as threat. Snopes, academic analysts, historians documented the parallels. Miller knew. The choice was deliberate.

How It Will Happen Here

Accountability requires no military occupation. Three elements exist or remain inevitable.

Political Transition. Nuremberg occurred six months after Germany’s surrender, not during Nazi rule. The 2026 midterms or 2028 election will likely produce Democratic majorities or a Democratic president. What is now documentation will become evidence in tribunals. A Democratic House could issue subpoenas by January 2027 and criminal referrals would follow.

International Jurisdiction. The ICC has authority when domestic systems fail. The Rome Statute permits ICC jurisdiction over Americans for crimes in member states’ territories or involving their citizens. U.S. deportation flights to ICC member states create jurisdiction. ICC Prosecutor Khan can open investigations without U.S. consent.

If future administrations refuse prosecution, foreign nations will act independently. Universal jurisdiction allows Germany, France, Spain, the Netherlands, Belgium to prosecute crimes against humanity regardless of location. Spain prosecuted Argentine military officers. Belgium indicted Rwandan genocide perpetrators. German courts convicted Syrian officials for torture.

Colombia accused the U.S. of murdering its citizen, Alejandro Carranza. Colombian prosecutors can issue arrest warrants for Hegseth under universal jurisdiction. If he travels to ICC member states or countries recognizing universal jurisdiction, authorities can detain and prosecute him. Chilean dictator Augusto Pinochet was arrested in London in 1998 on this basis.

Documented Evidence. Congressional committees, investor general reports, court rulings compile the record. Courts found ICE violated constitutional protections. Internal memos authorizing warrantless searches, Trump's Truth Social directives, Venezuela flight logs, Pentagon records showing boat strike authorization, Patel's FBI personnel actions, ICE use of tear gas on families all remain in federal archives.

Nuremberg prosecutors relied on Nazi documentation. American prosecutors will rely on federal databases, FOIA requests, congressional testimony, court records.

Responsibility Attaches to Individuals

Donald Trump ordered targeting of cities that voted against him for immigration enforcement, transforming law enforcement into political punishment. He ordered an unauthorized regime change operation in Venezuela that resulted in over 80 deaths, directed military threats against “the enemy from within.” After being informed of Nazi parallels, he deployed Hitler’s “vermin” and “poisoning the blood” rhetoric, then doubled down.

Stephen Miller set arrest quotes of 3,000 per day, threatened officials with termination for failing to meet deportation targets, architected policy calling for “100 million deportations” explicitly targeting “the third world.” He delivered a speech at Kirk’s memorial that near-plagiarized Goebbels’ 1932 “Storm is Coming” address, deploying identical techniques of martyrdom-as-mobilization and dehumanization of opponents.

Kristi Noem expanded detention 75 percent while overseeing operations that detained over 170 U.S. citizens. She authorized an ICE memo permitting warrantless home entries using administrative warrants agents sign themselves.

The White House claimed Admiral Bradley made the decision for the second strike that killed survivors. Thirty-five strikes killed 115 people, many fishermen with no drug trafficking ties.

JD Vance defended ICE tactics after a tear gas incident requiring CPR on an infant, defended the killing of U.S. citizen Renee Good by calling it “a tragedy of her own making,” defended the detention of a five-year-old child and use of chemical weapons against peaceful protesters.

Gregory Bovino, a Border Patrol commander, repeatedly violated court orders prohibiting use of chemical weapons against peaceful protesters. Federal Judge Sara Ellis found he was “outright lying” about use of force and admitted under oath to fabricating claims about being struck by a rock before deploying tear gas. He threw tear gas at crowds in Minneapolis and Chicago parks in violation of temporary restraining orders.

The Nuremberg Parallels

Hermann Göring commanded the Gestapo and the concentration camp system that processed millions. Trump commands ICE and a $45 billion detention infrastructure three times the size of the apparatus Göring inherited.

Heinrich Himmler directed persecution of targeted populations. Miller sets 3,000 daily arrest quotas and architects “100 million deportations” targeting “the third world.”

Wilhelm Frick drafted the Nuremberg Laws enabling systematic persecution. Noem authorizes warrantless home entries and overseas operations detaining U.S. citizens.

Julius Streicher published antisemitic propaganda, held no government office, was executed. Vance holds the second-highest office and defends tear-gassing infants and killing U.S. citizens.

Hans Fritzsche broadcast Nazi propaganda was convicted by German courts. Vance travels to Minneapolis to defend ICE operations after an agent kills Renee Good.

Wilhelm Keitel authorized military operations resulting in civilian deaths. Hegseth authorized boat strikes in international waters that killed survivors.

Joseph Goebbels delivered “The Storm is Coming” in July 1932, transforming Horst Wessel’s death into fascist mobilization. Miller delivered near-identical rhetoric at Kirk’s memorial in September 2025, deploying the same techniques of martyrdom, dehumanization, and threat.

Lower-level SS commanders were prosecuted for carrying out atrocities. Bovino deploys chemical weapons and repeatedly violates court orders.

Nuremberg established that following orders provides no defense. Responsibility is attached to those who authorize, execute, or defend attacks on civilian populations.

Accountability for Enablers

Supreme Court justices granted Trump immunity for “official acts.” Senate Republicans voted against conviction in both impeachments.

Nuremberg established that enablers bear historical responsibility even when domestic law shields them. Their names will appear in congressional reports, academic studies, tribunal filings. While they may escape criminal liability, the historical record remains.

Future historians will note impeachment was available. They will note 43 senators acquitted twice. They will note the Court granted immunity six months before Trump targeted cities that voted against him.

When It Begins

If Democrats control the House after November 2026, subpoenas issue in January 2027. If they win in 2028, grand juries convene within months.

The ICC Prosecutor can open examinations immediately. Colombian prosecutors can issue warrants. European nations act independently.

Trump’s “I am your retribution,” his “vermin” speech, his “poisoning the blood” repetitions, Miller’s Goebbels speech, DHS’s “100 million deportations” screenshot, deployment logs, budgets, memos—all remain.

Political cycles end, but documentation endures. History's architects of atrocity have always recorded their crimes with bureaucratic precision. The Nazis documented the Holocaust in meticulous detail. Trump's administration has done the same, creating an evidentiary record that will outlast any immunity, any Senate acquittal, any temporary shield from accountability.
